Terms and Conditions of Sale
1. Preamble
These Terms and Conditions of Sale (“T&Cs”) govern the relationship between, on the one hand, Swan Skora, publisher of the website https://playerzone-shop.com/ (hereinafter “PlayerZone” or the “Website”), and, on the other hand, any purchaser (hereinafter the “Customer”) wishing to acquire the products offered for sale (the “Products”) via the Website.

The Customer is understood to be a natural person of legal age (or otherwise having legal capacity) purchasing on the Website for non-professional purposes.
For the purposes of these T&Cs, PlayerZone and the Customer are collectively referred to as the “Parties” and individually as a “Party”.
In accordance with Articles L.223-1 et seq. of the French Consumer Code, if you do not wish to receive telephone solicitations on the number communicated to PlayerZone, you may register your number at any time on the Bloctel list (www.bloctel.gouv.fr).
2. General Provisions
The Website was designed by PlayerZone, which holds all related rights. Except with prior written authorization from PlayerZone, it is forbidden to copy or download all or part of the Website or its content.
The Products offered for sale on the Website are each described in a dedicated product page indicating their essential characteristics within the meaning of Article L.111-1 of the French Consumer Code.
Validation of an order on the Website (hereinafter an “Order”) constitutes the Customer’s express, unconditional acceptance of these T&Cs. The Customer acknowledges having the required capacity to contract and to purchase the Products offered on the Website, and to be aware of applicable regulations regarding the use of these Products in their country (notably in France).
The Customer declares to have read these T&Cs before initiating the online ordering process. In any event, placing an Order constitutes acceptance without reservation. The applicable T&Cs are those in force on the date the Order is placed.
These T&Cs remain in force for the duration necessary to supply the Products. For Orders outside mainland France, it is the Customer’s responsibility to check any import and use restrictions with their local authorities. PlayerZone cannot be held liable for the purchase of a Product deemed non-compliant in a given country where such Product complies with French regulations.
3. Prices
Product prices are displayed in euros, all taxes included (TTC), excluding delivery, packaging and handling fees, which are shown before final Order validation.
The total amount due is the amount shown in the Order summary (including delivery fees), which the Customer reviews before confirming the Order. Any prices shown in other currencies are for indicative purposes only.
PlayerZone reserves the right to modify prices at any time. Products are invoiced at the price in force at the time of PlayerZone’s Order confirmation.
The price is payable in full, in a single payment, on the day the Order is placed, via secure payment.
PlayerZone may offer third-party payment methods or services over which it has no control or influence. Customers choosing to use them do so under their sole responsibility and in accordance with the third parties’ terms.
4. Orders and Order Confirmation
Before placing an Order, the Customer acknowledges having been provided, in a readable and understandable manner, with these T&Cs and all information required under Articles L.111-1 to L.111-8 of the French Consumer Code, including:

the essential characteristics of the Product;

the price of the Product and any incidental costs;

where the contract is not performed immediately, the date or timeframe for delivery;

information about PlayerZone’s identity and contact details;
-
information about statutory warranties and how to exercise them;
-
the possibility of mediation in the event of a dispute;
-
information relating to the right of withdrawal.
The Customer may browse the Website freely without being bound by an Order. The Parties acknowledge that Products presented on the Website may no longer be available at the time of ordering.
To place an Order, the Customer must:

Add Products to cart by clicking “Add to Cart”;

Open the cart (“Cart” icon) and click “Checkout”;

Enter personal information or sign in to their customer account; the Customer is responsible for the confidentiality of their credentials;

Accept these T&Cs (checkbox) and confirm the Order;
-
Choose the delivery address and method;
-
Pay for the Products as instructed.
PlayerZone may suspend or close a Customer account in case of a breach of these T&Cs (after notifying the Customer and allowing reasonable time to comply). Any Customer whose account has been suspended/closed may not place future Orders without prior authorization from PlayerZone.
The Order is deemed accepted by PlayerZone provided that payment is received within five (5) days following the Order. PlayerZone will then confirm acceptance (and provide the T&Cs in PDF format) by email. Confirmation—or refusal, where applicable—will be sent no later than 48 business hours after receipt of the Order and its payment (except where otherwise indicated on the Website).
5. Delivery
As information, Products are mainly shipped from China and delivery is handled by third-party carriers.
For each Order, a flat contribution to shipping costs is calculated automatically according to the delivery location, the weight of the Order and the selected carrier. PlayerZone aims to deliver within 5 to 15 business days for France; these timeframes are indicative averages (processing + transit).
PlayerZone will inform the Customer of any foreseeable delay.
If the Products are not delivered within the agreed timeframe or, failing any, within thirty (30) days of the Order, the Customer may request termination of the sale and a refund if, after having formally requested delivery within a reasonable additional period, PlayerZone has not complied. PlayerZone will refund the Customer within fourteen (14) days from receipt of the termination notice.
If additional shipping costs arise due to an incorrect delivery address, wrong recipient, or impossibility of delivery, such costs shall be borne by the Customer.
Shipping costs are calculated at checkout based on the total weight and destination address.
Delivery is available throughout Europe. If your country is not available at checkout, please contact us via the Website contact form.
In case of absence upon delivery, the carrier will leave a delivery notice inviting the Customer to collect the Products.
Title and risk in the Products pass to the Customer upon physical possession of the Products.
Some international Orders to third countries may be subject to customs duties or taxes. The carrier may request payment of these fees prior to handing over the parcel. The Customer agrees to pay any applicable customs duties, VAT, or other taxes relating to import in the country of delivery.
Pursuant to Article L.216-14 of the French Consumer Code, the risk of loss or damage passes to the consumer when they, or a third party they designate (other than the carrier proposed by the professional), physically take possession of the goods.
6. Payment
Payment is made online at checkout by the available methods (e.g., Visa, MasterCard, American Express, UnionPay, PayPal, online banking, Apple Pay, etc.). Payment must be made in full when the Order is placed.
The authorization request for card debit is made upon Order validation (unless servers are unavailable). PlayerZone may retry authorization if the first attempt fails due to server unavailability.
In case of non-payment, incorrect address, or any other account issue, PlayerZone may block the Order until the issue is resolved.
In case of fraudulent use of a payment card on the Website, the Customer should contact PlayerZone at contact@playerzone-shop.com.
Invoices are archived on a reliable and durable medium. In addition, pursuant to Article L.213-1 of the French Consumer Code, PlayerZone undertakes to retain and archive, on any medium, for ten (10) years, contracts concluded between the Customer and PlayerZone for an amount equal to or greater than €120, and to guarantee access to them by the Customer at any time.
7. Right of Withdrawal / Returns
Customers purchasing at a distance benefit from a 14-day right of withdrawal in accordance with Article L.221-18 of the French Consumer Code.
The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and designated by you, physically take possession of the goods.
To exercise the right of withdrawal, you must notify PlayerZone (contact@playerzone-shop.com) of your decision to withdraw by means of an unambiguous statement (e.g., letter sent by post or email). You may use the model withdrawal form below, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the 14-day period has expired.
In the event of withdrawal, we will refund all payments received, including delivery costs (except additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us), without undue delay and, in any event, no later than 14 days from the day we are informed of your decision to withdraw. We will make the refund using the same means of payment as used for the initial transaction, unless you expressly agree otherwise; in any event, the refund will not incur any fees for you. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return the goods to us without undue delay and, in any event, no later than 14 days from the day on which you communicated your decision to withdraw. The deadline is met if you send back the goods before the 14-day period has expired.
We will bear the costs of returning the goods, except in specific cases where PlayerZone will inform you depending on the situation. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods.

8. Warranties / Liability
Products sold on the Website comply with applicable French regulations. Product photos are non-contractual. The Customer accesses and uses the Website at their own risk.
Products supplied by PlayerZone benefit, by operation of law and without additional payment, independently of the right of withdrawal, from:

the legal warranty of conformity (Articles L.217-3 et seq., French Consumer Code) for Products that are apparently defective, damaged, or non-conforming to the Order; and
-
the legal warranty against hidden defects (Articles 1641 et seq., French Civil Code) arising from a material, design or manufacturing defect making the delivered Products unfit for use.
In accordance with Article D.211-2 of the French Consumer Code, the following information applies (extracts summarized in English):

The consumer has two years from delivery to invoke the legal warranty of conformity in case of a lack of conformity. During this period, the consumer is only required to prove the existence of the defect, not the date of its appearance.

Where the sale provides for continuous supply of digital content/service for more than two years, the legal warranty applies throughout the supply period.

The legal warranty of conformity includes the professional’s obligation to provide all necessary updates to maintain conformity.
-
The consumer is entitled to repair or replacement within 30 days of the request, free of charge and without major inconvenience.

If repaired, the legal warranty is extended by six months.
-
If the consumer requested repair but the seller imposed replacement, the legal warranty is renewed for two years from replacement.

The consumer may obtain a price reduction (keeping the goods) or terminate the contract (full refund against return) if:
-
the professional refuses repair/replacement;
-
repair/replacement occurs after 30 days;
-
repair/replacement causes a major inconvenience (e.g., the consumer permanently bears return/removal/installation costs);
-
non-conformity persists despite the seller’s attempt to remedy it.

The consumer may also obtain an immediate price reduction or contract termination where the lack of conformity is so serious that such remedy is justified.

There is no right to termination if the lack of conformity is minor.

Any period during which the goods are out of use for repair/replacement suspends the warranty period.
-
Bad-faith obstruction by the seller to the implementation of the legal warranty of conformity may result in a civil fine (Article L.241-5).

The consumer also benefits from the warranty against hidden defects (Articles 1641 to 1649, Civil Code) for two years from discovery of the defect (price reduction or full refund against return).
9. Intellectual Property
All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as any software applications used on the Website—and more generally all elements reproduced or used on the Website—are protected by applicable intellectual property laws.
They are the exclusive property of PlayerZone or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including software applications, without prior written consent of PlayerZone, is strictly prohibited. Failure to act immediately upon knowledge of unauthorized uses does not constitute acceptance or waiver of action. Any simple or deep hyperlink is strictly prohibited without PlayerZone’s express written consent.
Any breach of the above constitutes infringement and may expose the infringer to civil and criminal penalties.
If the Customer submits content (e.g., contest entries, creative suggestions, designs) online, by email, post or otherwise, the Customer agrees that PlayerZone may edit, copy, publish, distribute, translate and use such content in any media, and waives any claim to intellectual property, payment or compensation relating to such submissions.
10. Personal Data
When the Customer browses the Website, creates an account and/or places an Order, PlayerZone acts as the data controller for personal data provided by the Customer.
For more information on how PlayerZone collects and processes personal data and on your rights (access, rectification, objection, deletion, portability), please refer to the Privacy Policy available on the Website or contact contact@playerzone-shop.com. Processing complies with applicable regulations, including the GDPR for EU users.
11. Force Majeure
Any circumstances beyond the Parties’ control preventing normal performance of their obligations constitute grounds for exemption and suspension of obligations.
The Party invoking such circumstances must promptly notify the other Party of their occurrence and end.
Events typically recognized under French case law as force majeure (e.g., transport or supply blockages, earthquakes, fires, storms, floods, lightning, telecom network outages or external network issues) are expressly considered force majeure.
The Parties will confer to assess the impact and agree on conditions for continuing performance. If the force majeure event lasts more than three (3) months, the affected Party may terminate these T&Cs.
12. Governing Law and Jurisdiction
These T&Cs are drafted in French and governed by French law, regardless of the Customer’s nationality or the place the Order is validated.
The Website and these T&Cs comply with French law; PlayerZone does not warrant compliance with any foreign legislation.
Any dispute between the Customer and PlayerZone relating to the interpretation or performance hereof falls under the exclusive jurisdiction of the French courts, in accordance with the French Code of Civil Procedure.
Pursuant to Article R.631-3 of the French Consumer Code, in the event of a dispute, the consumer may bring the matter before the territorially competent court under the Code of Civil Procedure or the court of the place where they resided at the time of contract conclusion or of the harmful event.
In accordance with Articles L.611-1 and R.612-1 et seq. of the French Consumer Code on amicable dispute resolution, where the Customer has submitted a written complaint to the professional and has not received a satisfactory response within two (2) months, they may submit their claim free of charge to a consumer mediator within one year of the initial complaint.
If one or more provisions of these T&Cs are held invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the remaining provisions shall retain their full force and effect between the Customer and PlayerZone.
